VA Loans and Your Real Estate Agent: What Has to Be True in the Contract

The split of labor on a VA purchase

Jodie pulls the Certificate of Eligibility, runs residual income, structures the funding fee, and originates the loan through NEXA Mortgage (NMLS #1660690). The buyer’s agent writes the purchase agreement, schedules inspections, and negotiates repairs after the VA appraisal. The VA appraiser works for the VA’s appraisal management process, not for your agent and not for Jodie.

Nobody on that list is “the VA.” The Department of Veterans Affairs guarantees a portion of the loan. It does not hand you keys at a base housing office. Materials on this site are not from VA, HUD, or FHA and were not approved by those agencies.

You cannot waive the VA appraisal — write the offer like you know that

Conventional waivers and “appraisal-gap coverage” folklore get pasted onto VA offers. You cannot waive the VA appraisal. You can bring cash to cover a gap if you actually have the cash. You can renegotiate. You can walk. Have the agent write that honestly so a Kootenai lake seller or a Midlothian builder is not surprised.

Minimum Property Requirements are not cosmetic. Heat, roof, water, peeling lead paint, egress, and safety items can force repairs. An agent who says “we will deal with MPRs later” is scheduling a fight for week three. Walk older downtown Kennewick, downtown Belton, and Hayden Lake cabins with MPR eyes on day one.

Seller concessions, the funding fee, and the Loan Estimate

VA limits how much a seller can concede. The funding fee can usually be financed; many disabled veterans are exempt. If the agent writes a concession that looks like they are paying your funding fee in a way the investor will not allow, the LE and the contract diverge and underwriting stalls. PCS, BAH, and agents who only work one gate

Builders on the Cavazos corridor, in Southridge, and in Moseley will push an in-house lender. You can say no. Compare the incentive as a number. VA still needs a VA-capable appraisal and MPRs on a new build. An agent who registers you correctly with the builder protects compensation and keeps the addenda clean. An unrepresented buyer in a design center is how people give away both.
